Company. Owners and Tenants should obtain condominium insurance to cover liability and their personal property from fire, theft, etc. for the areas not covered under the Master Policy of the Association. Please consult with your insurance agent for proper coverage.

B.   Any claim filed by an Owner against the Association’s insurance policy for damage to the Owner’s home, caused by covered occurrences, shall be subject to a deductible. This deductible shall be paid by the party or entity that is responsible for the maintenance of the item which caused the damage, and/or for any damages or a covered incident under the Association’s policy.

C.   Owners have the option to procure and maintain insurance coverage for  any deductible, or be responsible personally for any deductible. Any Owner who fails to procure the proper insurance coverage shall be personally responsible for the full amount of the deductible.

D. Interior damage caused by damage to Common or Limited Common Elements will be the responsibility of the Owner and/or their insurance. For example, if a tree falls on the roof, the Association is responsible for the roof repairs, but if there is damage to the inside of the home from this occurrence, the Owner is responsible for those repairs.

10) LANDLORD /TENANT OBLIGATIONS

A.   An Owner who rents their home is required to provide the Property Management Company a copy of the current lease, and the Certificate of Occupancy (COO) required by the  Township of Clinton. This is to be provided prior to the start of the lease. The Owner is responsible for providing the tenant with a copy of these Rules & Regulations of the Association.

B.   The Owner is responsible for their Tenant’s compliance with the Rules & Regulations of the Association. The Landlord (Homeowner), as well as the tenant, will be informed of any violations.

C.  Owners leasing their home must abide by the following:

1.    All Restrictions contained in Article 9.3 of the Master Deed, which prohibit short term leasing of any type (i.e.: vacation rentals, short stays, transient, AirBNB type agreements and leases).

2.   Leases will be no less than 180 days (6 months) per Article 9.3(a)

3.    The signed lease must be submitted to the Property Manager, along with the Township’s Certificate of Occupancy (COO), PRIOR to the tenant moving in. The Township of Clinton requires a COO anytime there is a change of resident (new lease) or change of ownership. Smoke/Carbon monoxide detectors are tested during this inspection and the certificate will not be granted until they are deemed in compliance. If it is discovered that a new lease was not submitted prior to the tenant moving in, and a COO was not obtained, a fine will be assessed by the Association and additional fines may be issued by the Township of Clinton.
